1. Vehicle Software & Remapping Services
AGK provides professional vehicle software and diagnostic services, including ECU remapping, gearbox/TCU remapping, performance and economy calibration, diagnostics and other vehicle software solutions.
Any quoted increases in power, torque or fuel economy are estimates only. Actual results may vary depending on the vehicle, engine condition, existing software, fuel quality, modifications, maintenance history and other factors.
No specific power, torque or fuel-saving figure is guaranteed unless explicitly agreed otherwise in writing.
2. Vehicle Condition
The customer is responsible for ensuring that the vehicle is mechanically suitable for the requested work.
Where appropriate, AGK may carry out diagnostic or vehicle health checks before performing software modifications. These checks cannot guarantee that every existing, intermittent or developing mechanical or electrical fault will be detected.
AGK reserves the right to refuse or postpone work if the vehicle appears unsuitable for the requested service.
Performance software can place additional demand on components including, but not limited to, the engine, turbocharger, clutch, gearbox, injectors, cooling system and drivetrain. Existing weaknesses or worn components may become more apparent following modification.
3. Existing & Subsequent Faults
A software modification does not repair an underlying mechanical or electrical defect unless that specific repair forms part of the agreed service.
If a customer requests a software solution in an attempt to address an existing fault, warning message, limp mode or other vehicle problem, AGK does not guarantee that the requested software work will resolve the underlying problem.
The agreed charge may still apply where the requested work has been correctly completed but another mechanical, electrical or diagnostic issue remains.
4. Mechanical & Electrical Components
AGK cannot guarantee the remaining service life of existing mechanical or electrical components.
AGK will not be responsible for failures caused by pre-existing defects, wear and tear, poor maintenance, previous modifications, misuse or components already operating outside their intended condition.
Nothing in these terms excludes or limits liability where doing so would be unlawful or affects the customer's statutory rights.
5. DPF, EGR, AdBlue/SCR, NOx & Emissions-Related Services
AGK provides specialist diagnostic and software services relating to vehicle emissions systems, including DPF, EGR, AdBlue/SCR and NOx systems.
The customer is responsible for ensuring that any modification requested is lawful for the vehicle's intended use and complies with applicable road traffic, emissions, inspection, insurance and other legal requirements.
Some modifications may make a vehicle unsuitable or unlawful for use on public roads.
AGK does not advise customers to use a vehicle on public roads in a condition that does not comply with applicable law.
6. Insurance, Warranty & Legal Requirements
The customer is responsible for informing their insurer of any vehicle modification where required.
Vehicle modifications may affect manufacturer, dealer, aftermarket or third-party warranties. The customer should check applicable warranty conditions before proceeding.
AGK is not responsible for decisions made by vehicle manufacturers, dealerships, insurers, finance providers, warranty companies or other third parties regarding a modified vehicle.
7. Previously Modified Vehicles & Virtual Reads
Some ECUs may require a Virtual Read (VR), where suitable original software is obtained from a server rather than directly read from the ECU.
A vehicle may also have been modified previously without the customer's or AGK's knowledge. Where this cannot reasonably be identified before work begins, AGK cannot guarantee that the vehicle was operating on original manufacturer software before our service.
8. Mobile Service
AGK provides mobile services and may carry out work at the customer's home, workplace or another agreed location.
The customer must provide a safe and suitable location for the work to be performed and ensure that AGK has reasonable access to the vehicle.
Certain diagnostic, recovery or follow-up work may require different arrangements depending on the nature of the fault and the vehicle.
9. Customer-Supplied Information
The customer is responsible for providing accurate information about the vehicle, including any known faults, previous remaps, modifications, repairs or other relevant history.
AGK cannot be held responsible for issues resulting from material information that was withheld or was not reasonably available before the work was carried out.
10. After-Service Issues
If the customer believes there is an issue relating to work performed by AGK, they should contact AGK as soon as reasonably possible and allow AGK a reasonable opportunity to investigate.
Where appropriate, AGK may request diagnostic information or inspection of the vehicle before determining whether an issue relates to the supplied software or another vehicle fault.
11. Software Support
Where a genuine issue is identified with software supplied and installed by AGK, AGK will be given a reasonable opportunity to investigate and, where appropriate, correct the software.
Additional work resulting from unrelated mechanical or electrical faults, subsequent vehicle modifications, third-party software changes, ECU programming by another party or other circumstances outside AGK's control may be chargeable.
12. Cancellations & Refunds
Any cancellation, refund or repeat-work request will be considered according to the circumstances of the service provided and applicable UK consumer law.
Once bespoke vehicle software has been prepared, installed or a service has been substantially performed, cancellation or refund rights may be affected where permitted by law.
Nothing in these terms removes any statutory rights that the customer is legally entitled to exercise.
13. ECU Programming Risks
ECU/TCU programming requires communication with sensitive electronic control modules.
Although professional equipment and procedures are used, programming can be affected by circumstances outside AGK's reasonable control, including unstable vehicle voltage, existing ECU damage, communication failures, previously modified software or hardware faults.
The customer must disclose any known ECU/TCU problems or previous programming work before service.
14. Test Drive
Where appropriate and with the customer's permission, AGK may carry out or request a test drive before or after work to assess vehicle operation and verify the results of the service.
15. Limitation of Liability
AGK is responsible for providing its services with reasonable care and skill.
AGK is not responsible for losses or failures caused by circumstances outside its reasonable control, pre-existing vehicle defects, normal wear and tear, customer misuse, undisclosed modifications or faults unrelated to the service provided.
Nothing in these Terms & Disclaimer excludes or restricts liability where exclusion or restriction is prohibited by law.
16. Acceptance of Terms
By instructing AGK Automotive Solutions Ltd to proceed with work, the customer confirms that:
- they are authorised to approve work on the vehicle;
- they have disclosed relevant known faults and modifications;
- they understand the nature of the requested service;
- they understand that vehicle modifications may affect insurance, warranty, emissions compliance and road legality;
- they accept these Terms & Disclaimer subject to their statutory rights.
